Imagine that you’re an eight year old who just got a shiny new 3DS for Christmas. You and your kid relatives are having fun taking pictures and decide to see what you’ve snapped. You open up the picture folder to find not only your pictures but others that you weren’t expecting.

Your mind can’t make sense of what you’re seeing. “Whu… why are there naked people in these pictures and what are they doing? MOMMY? WHAT IS THIS?

That scenario I tossed at you is a dramatization of something that happened to an actual eight year old boy from Hampton, Virginia.

Tom Mayhew gave his son a Nintendo 3DS as a Christmas present. After his boy took pictures of himself and some other kids from his extended family, they went to check out them out. They not only found the pictures they had taken but also several dozen pornographic pictures inside of the “brand new” 3DS.

It was a shocker because we had family here, and there were a lot of kids here. The kids were the ones that discovered those pictures.

Mayhew thought that Nintendo had made a mistake but now has another theory.

It was possibly a bought item at one time and returned. Those things were not deleted from it, so it wasn't a new product. It was a used product.

Considering that the pictures were time stamped December 01 and the handheld was bought on December 23rd, this is most likely what happened.

WAVY 10 News contacted Wal-mart about this but they have yet to receive a reply.

This isn’t the first time that this has happened. Almost the exact same scenario happened last Christmas to a five year old. I guess the lesson here is that if you buy your kid a 3DS then you had better check to make sure that there aren’t any pictures that wouldn’t get the Nintendo seal of approval in it.
