Reminder: Videogame Supreme Court Case Opens Tuesday

As you are hopefully aware, the Most Important Case the United States Supreme Court has ever handled*, Schwarzenegger v. Entertainment Merchants Association/ Entertainment Software Association, will be officially underway next Tuesday, the 2nd of November. On that day, the Court will hear the opening oral arguments from both sides.

The Ninth Circuit Court of Appeals has already ruled that the 2005 California statue to regulate the sale and rental of games was unconstitutional, helping to secure the status of videogames as a protected form of free speech. The ESA will be asking the Supreme Court to uphold this ruling.

Immediately following, the ESA will be hosting an open teleconference with Michael D Gallagher and Ken Doroshow, the president and VP of the ESA, as well as Paul Smith, their legal council, to discuss the game industry’s arguments.
